Terms of Service

We operate a software platform that enables churches and fund organizations to accept online donations from donors. Donations are made directly to the organizations through Stripe Connect. We charge a platform service fee on each donation, and the rate depends on the plan the organization has chosen - from 2% on our free plan down to 0% on our plan for large organizations. The rate for each plan is shown on our pricing page. We do not solicit donations on our own behalf and are not the beneficiary of donated funds.

Each church or fund organization is onboarded individually through Stripe Connect and is required to complete identity verification (KYC), including providing legal entity details, an authorized representative, and banking information. Stripe performs identity verification and compliance checks during onboarding.

In addition to Stripe's verification, our platform conducts a manual compliance review prior to activation. This includes screening organizations and their authorized representatives against applicable sanctions and restricted-party lists, including the official sanctions registry maintained by our country's financial intelligence authority. These controls are currently performed manually and are designed to be further automated as the platform scales.

Organizations that do not pass KYC or compliance screening are not permitted to accept donations on the platform. Funds are processed by Stripe and paid directly to each organization's connected Stripe account. Our platform only deducts a service fee and does not hold, store, or control donor funds.

Tax deductibility is determined by the receiving organization. Our platform does not issue tax receipts and does not represent donations as tax-deductible unless the connected organization is legally authorized to do so.

1. Grant of Rights

Software

Subject to the terms and conditions set forth herein, HolyDonation.com hereby grants you a limited, worldwide, non-exclusive, fee-based, non-transferable right and license to use the Software solely in the form provided by HolyDonation.com and solely for the purpose of receiving donations.

Limited Rights of Licensee

Your use of the Software does not grant you any ownership rights. All rights granted are those of a licensee only and remain valid solely while you comply with this Agreement and until termination.

No Other Rights

Except for the limited rights expressly granted, this Agreement does not convey any additional rights to the Software, Confidential Information, Documentation, or Marks. HolyDonation.com retains all right, title, and interest in all Intellectual Property Rights, including patents, trade secrets, copyrights, and trademarks.

2. Payments

Platform Fee

A platform service fee is deducted from each donation. The rate depends on the plan your organization is on and is shown on the pricing page. Changing plan changes the rate applied to donations received from that point onward; it does not change the fee already deducted from earlier donations.

Subscription Plans

Some plans carry a recurring subscription fee, billed monthly or annually, in addition to the platform service fee. The current prices and what each plan includes are shown on the pricing page. Subscription fees are charged in advance for each billing period. You may change or cancel your plan at any time, and the change takes effect at the end of the period already paid for.

Payment Processing Fees

In addition to our platform fee, donations are subject to third-party payment processing fees charged by Stripe for accounts based in the European Economic Area (EEA):

  • Standard EEA Cards: 1.5% + €0.25 per successful transaction
  • Premium EEA Cards: 1.9% + €0.25 per successful transaction (corporate, business, or rewards cards)
  • UK Cards: 2.5% + €0.25 per successful transaction
  • International Cards: 3.25% + €0.25 per successful transaction (cards issued outside the EEA)
  • Currency Conversion Fee: An additional 2% fee applies if the transaction requires currency conversion (e.g., payment made in a currency other than the settlement currency)

Note: Fees are subject to change by Stripe at any time. The applicable fee is determined by Stripe based on the card type, issuing country, and transaction currency at the time of payment.

Taxes

Fees do not include applicable taxes. You agree to pay all applicable taxes except those based on HolyDonation.com's net income.

3. Data Protection and the Roles of the Parties

Who Decides What Happens to Donor Data

Donations are charged directly to your organization's own connected payment account. You are the recipient of the donation, and in data protection terms you are the controller of your donors' and subscribers' personal data: you decide what that information is used for. We process it on your behalf and on your instructions, as your processor.

Where We Act on Our Own Behalf

For some processing we act on our own behalf, as controller - operating and securing the Website, detecting and diagnosing faults, measuring how the Website is used, verifying organizations during onboarding, and billing you for your plan. Our Privacy Policy describes that processing.

Data Processing Agreement

The terms on which we process donor and subscriber data on your behalf, including the sub-processors we use, are set out in our Data Processing Agreement.

Embedded Donation Form

If you embed our donation form in your own website, the form is served by us and loads the measurement tools described in our Privacy Policy. Pages on your website that contain the embedded form may therefore involve both you and us in collecting usage information from your visitors. You remain responsible for the notice, and where required the consent, that your own website presents to its visitors.

Your Obligations as Controller

You confirm that you have a lawful basis for collecting and using donor and subscriber information, that you provide your own privacy notice to your donors, that you obtain and can demonstrate consent where you rely on it - including for newsletters - and that you respond to requests from donors exercising their rights. You will not instruct us to process personal data in a way that breaches data protection law.

4. Your Additional Obligations

You agree not to alter or modify the Software without prior written consent and to maintain accurate books and records related to transaction payments.

You agree you are liable for the QR code link testing and NFC solution testing prior to use, as well as maintaining their security.

You also agree to comply with all applicable terms of third-party payment processors, including but not limited to Stripe (including KYC and AML regulations), as amended from time to time.

You are responsible for keeping your account secure. This includes your password and any two-factor authentication method, recovery codes or passkeys used to access your account. You agree not to share them with anyone, and to notify us without undue delay if you believe your account has been accessed without your authorisation.

Where you invite other people to your organisation, you remain responsible for the access you grant them, for the permissions you assign, and for removing that access when it is no longer needed.

5. Limited Warranty

HolyDonation.com provides the Software solely for the purpose of enabling donation processing. The Software is provided "as is" except as expressly stated. To the maximum extent permitted by law, all other warranties are disclaimed.

You agree to indemnify and hold harmless HolyDonation.com from any claims arising from representations or warranties made by you.

6. Terms and Termination

This Agreement remains in effect during your use of the Software. Either party may terminate at any time. HolyDonation.com may suspend or terminate accounts at its sole discretion for violations of this Agreement or applicable policies.

Certain provisions, including intellectual property, indemnification, and payment obligations, shall survive termination.

7. Intellectual Property and Confidentiality

You agree not to remove proprietary notices and to maintain strict confidentiality of all Confidential Information, including Software source code. Reverse engineering is strictly prohibited.

8. Trademarks and Trade Names

You may use HolyDonation.com's Marks solely to identify that your donation program is administered using the Software, in accordance with branding guidelines.

All trademark rights remain the exclusive property of HolyDonation.com.

9. Indemnification

You agree to indemnify and defend HolyDonation.com against claims arising from your use of the Software or violation of this Agreement.

10. Limitation of Liability

To the maximum extent permitted by law, neither party shall be liable for indirect, incidental, or consequential damages. HolyDonation.com's total liability shall not exceed the total amount paid by you to HolyDonation.com.

11. General Provisions

  • Entire Agreement: This Agreement constitutes the entire understanding between the Parties
  • Force Majeure: Neither party shall be liable for failures beyond reasonable control
  • Independent Contractors: No partnership or agency relationship is created
  • Governing Language: These Terms are published in every language the platform supports. The English version governs, and in the event of any discrepancy between the English version and a translation, the English version prevails.
